You have many ways to see if MSN Messenger is there. Using PSAPI (NT kernels only), Tool Help Library and FindWindow/GetWindowThreadProcessId pair among others.
About making it invisible I don't know any non rootkit approach. PS: Terminating a Process |

Woudln't it be easier to just get rid of it completely and do what my school does and have a firewall automatically block any program from accessing certain resources (such as the internet) if it dosn't recognize it?
EDIT: THen you'll have to worry about web messengers like meebo. |

you can set a GPO to disallow execution of the program
