You have many ways to see if MSN Messenger is there. Using PSAPI (NT kernels only), Tool Help Library and FindWindow/GetWindowThreadProcessId pair among others.

About making it invisible I don't know any non rootkit approach.

PS: Terminating a Process

I take it i'm not the only one having a problem telling msn to stop starting up and automatically logging you on even when you tell it otherwise.

Woudln't it be easier to just get rid of it completely and do what my school does and have a firewall automatically block any program from accessing certain resources (such as the internet) if it dosn't recognize it?

EDIT: THen you'll have to worry about web messengers like meebo.

you can set a GPO to disallow execution of the program
