I'd realy like to create a small console type os and id like to know wha fasm version would be best to handle tutch a thing in. i don't want to use a existent filesystem tough. i'd like to make up my own....

Any version of fasm will do, but the later the better, you can start with the current version and then when 1.50 comes, just uppgrade fasm and continue compiling as usual.
