Actually on apples store the iPhone starts at $199:

But, $700 dollars for a last generation iPod is to much. Considering it has no multitasking. Unless of course it's 32GB is filled with all sorts of games and apps witch since it is used is probably my guess.

The (R) means a registered trademark. There is no reason to assume that fasm could never have a registered trademark. It can still be free software (BTW: it is BSD-like, not GPL) and also have a registered trademark. One does not exclude the other, they are completely separate things.
