Hi.

I'm a little confused about the license and it's not clear to me over doubt I have.
Can I program a software in fasm and publish it with the source code closed? or am I always obliged to publish it?

The license does not apply at all to the software that you create with fasm. The license only regulates how to redistribute fasm itself.

The only obligation you have is to include fasm's license and the name of original author (me) when you redistribute fasm in any form. This applies to cases like inclusion of fasm in your own software (for example if you make and distribute compiler that has fasm as part of its toolchain, or as a library) or if you modify fasm and publish it as a derivative assembler.
