Oh common. Patents are fine... outside of software.

You should recieve credit for inventing the zipper, and you should recieve credit for inventing the printing press.

But patents were designed to be fair when patenting ideas similar to soap. Software is nothing like soap, in fact, ideas that software have just don't make sense most of the time, because patents were made for soap, not software.

That's not true! All idea behind patents is to protect ideas. The problem with software patents is - are we think of software development as technical invention or as an art? Software can be protected enough by copyright laws, the same way as music, writings and other arts are protected.

There is many differences between patenting software and patenting in other fields. Some of them:

1) In countries where software patents are legimitime, software is "protected" both by copyright law and patents law. You can't find the same thing in other fields, as copyrights protects intelectual property (music, writings, etc...), but patents protect technical inventions. So you must decide, what software is - art or technical invention?

2) In IT field technologies are evolving very very fast, so patent lifetime of 20 years practically speaking means that patent holder will have lifetime monopoly on specific idea.

How does m$ going to check usage of double or single click on my machine?

You cannot patent ideas: patents are for process involving an energy transformation of any kind.

Doubleclick?

To launch an application using mouse, one should do the following:
- press left button;
- release it;
- press again - program starts at this time!!

So, actually we might patent this *1.5 click* and earn a lot of money from microsoft Very Happy

this is old news... luckily we here in the EU doesn't have that absurd patent law -- but FEAR! we MIGHT! (if the idiots may decide!!!!)

Besides, they're seeking patent for virtual dekstop manager-- you know the stuff that's been avalible in (among others) most window managers running on linux for many many many years....

I wonder, can I patent the process of ensuring nobody else can take advantage of my innovations/creations..... (ie patenting the patent process, though, I'd probably succed and if I patented sueing/prosecuting, then no one would be able to prosecute me (to test if the pataent I gained is legal, as the __ patent office doesn't investigate patent request anymore but just accept them an let the one with most lawyers decide who's right in a court......))
